Background and Discussion:
This agreement will provide approximately 86,743 rentable square feet (RSF) of office space located at 4425 Westway Park Boulevard, Suite 100, Houston, Texas 77041, for an Initial Term of 135 months. The Commencement Date will be the later of (a) two hundred seventy (270) days after Landlord delivers possession of the Premises to the Flood Control District, or (b) February 1, 2027. The agreement may be extended after the Initial Term for two (2), five (5) year Extension Periods at the Flood Control District's discretion. The Flood Control District may also elect to terminate the agreement early, effective at the end of the ninety-ninth (99th) month of the Initial Term, upon twelve (12) months' written notice and payment of an early termination fee as set forth in the agreement. The Limit of Appropriation necessary to satisfy the full 135-month Initial Term shall not exceed $32,198,751.52.
