Request by the Department of Economic Equity and Opportunity for approval to amend the contract term of the joint interlocal agreement with Alief Independent School District, Aldine Independent School District, and Spring Independent School District to conduct a localized disparity study regarding the utilization of Minority and Women-Owned Business Enterprises (MWBEs).

Background and Discussion:
On August 8, 2023, the Court approved the awarding of Aldine ISD, Alief ISD, and Spring ISD up to $200,000 per District for a total of $600,000, and the original Agreement had a term of 24 months. All Parties understood that Aldine ISD, Alief ISD, and Spring ISD would procure, select, and award a contract to a single vendor that would conduct a disparity study for each of the three school districts and report its findings and recommendations. Each ISD would pay for one-third of the total cost associated with the studies. The original Agreement required the vendor to complete the study within 12 months.
After completing the procurement process and selecting the vendor for the studies, the ISDs requested a 12-month extension of the contract term without additional funding to accommodate the vendor’s needs and the school districts’ schedule in terms of completion of the studies and implementation of policies. Specifically, the amended Agreement requires the completion of the study within 24 months (i.e., by August 2025) and adopted policy and procedures to be in place to address identified racial and/or gender-based disparities (if any are found) within 36 months (i.e., by August 2026).
Expected Impact:
By amending the contract term, the selected vendor will be able to provide more comprehensive findings and recommendations to the school districts. Upon completing the disparity study, Alief, Spring, and Aldine ISD will act in good faith to review the study’s findings and implement strategies to remedy any disparities found.
Alternative Options:
The court can choose not to amend the Agreement, and Alief, Spring, and Aldine ISD will be unable to complete the disparity studies in their entirety within the original timeframe.
