Background and Discussion:

The above is an eminent domain matter involving the Cedar Bayou East & West Subdivision Improvement Road Project located in Precinct 2. Harris County, Texas took a drainage easement to 0.0808 acres (3,518 square feet) as well as a 14-month temporary construction easement to 0.0779 acres (3,393 sf).  The Special Commissioners awarded $ 9,446.00 which was deposited into the registry of the Court. Harris County’s appraisal for the just compensation due to the landowner was $ 9,446.00. The parties have agreed that the just compensation due to the landowner for this taking is $ 40,000.00. The Real Property Division & Precinct 2 participated in the settlement negotiations and this settlement is acceptable to them.  An order authorizing the settlement of this lawsuit is attached for use by the Court if it decides it would be in the best interest of the County to settle this claim.
