Background and Discussion:
In March 2016 Harris County entered into an agreement with the Texas Department of Transportation for construction, operation and maintenance of a toll road facility on SH 249 from south of Brown Road to Spring Creek. Harris County agreed to obtain any additional right-of-way required for the construction of the project and transfer any portion of the right-of-way acquired for the frontage road construction to the State of Texas. These 12 parcels were acquired for frontage road construction by Harris County and are subject to the terms of the March 2016 agreement.

Expected Impact:
The transfer of right-of-way to the State will reduce Harris County expenses by eliminating the maintenance obligations and costs associated with 11.8485 acres of road right-of-way.

Alternative Options:
Harris County is obligated by agreement to transfer any properties acquired for the frontage road construction to the State of Texas. No other options possible.
