Request for approval allowing Harris County to file an amicus brief in Ipsum General Contractors, LLC, et al v. Kelly Hancock, et al., currently pending in the District Court of Travis County, Texas, challenging the recent overhaul of the Historically Underutilized Business (HUB) program.

Background and Discussion:
Several business owners and a trade association sued the State of Texas and Acting Comptroller Kelly Hancock over the Comptroller's rules changing Texas's HUB program. The lawsuit alleges that Comptroller Hancock overstepped his authority in freezing the HUB program, arguing, among other things, that members of the executive branch (Comptroller Hancock) cannot rewrite laws passed by the state legislature. When appropriate, we would like to file an amicus in support of the plaintiffs in this case.
