Request for approval of an order authorizing the County Attorney, for a period of six months, to file litigation against the federal government and its officers challenging the Executive Orders issued by President Donald J. Trump and any associated rules or regulations that may impact Harris County.

Background and Discussion:
President Trump’s Executive Orders have already had an impact on Harris County and its residents. Vaguely-worded orders without clear directives are impacting federal government grants to Harris County, including an order from the Office of Management and Budget freezing all federal grants for a period of time. Given the sudden nature of these orders and the exigency of taking legal action, the County Attorney requests authority to quickly challenge these orders without having to wait for the next commissioners court meeting. The County Attorney’s Office will place discussion items on the next commissioners court agenda following the institution of legal action. The authority requested will last no longer than six months initially, with a request for renewal coming after the end of that period.
