Request Summary (Agenda Caption):
title
Request for approval of an amendment to the Market Valuation Waiver Agreement for SH 99 (Grand Parkway) pursuant to which the Parties set forth the terms and conditions for the development of the Grand Parkway (Precincts 2, 3, and 4).
end
Background and Discussion:
The Texas Department of Transportation (TxDOT) and Brazoria County, Chambers County, Fort Bend County, Galveston County, Harris County, Liberty County, and Montgomery County are parties to the Market Valuation Waiver Agreement (MVWA) for SH 99 (Grand Parkway), effective as of March 25, 2009, which was entered into pursuant to former Texas Transportation Code (TTC), Section 228.0111, and which relates to the development, construction, and operation of the Grand Parkway Project.
In coordination with each party of the MVWA, TxDOT is proposing an amendment to the agreement related to setting of toll rates for non-electronic toll transactions and project scope. The amendment will allow each party, in its discretion, to set and determine toll rates for transactions involving vehicles that do not have a valid transponder. The amendment also allows direct connectors not identified in the minimum project scope to be constructed as long as construction of direct connectors does not result in a negative impact on the toll revenue for the Grand Parkway System (as determined by a traffic and revenue consultant).
Expected Impact:
Approval of this amendment will ensure a responsible party may determine appropriate changes to the non-electronic toll transactions and direct connectors.
Alternative Options:
No other recommended solution for this identified need.
