Background and Discussion:

Each year, the Harris County Housing and Community Development (HCD) receives an award as “Participating Jurisdiction” entitlement community under the U.S. Department of Housing and Urban Development’s (HUD) CDBG, HOME and ESG programs. HUD regulations allow up to 20%, 10% and 7.5% (CDBG, HOME and ESG) of the annual award to be utilized for administering the programs.  Historically, HUD sends the award announcements / letters to Harris County after the start of the County’s fiscal year.  Since the County will not receive its 2024 HUD award letter on or before October 1, 2024, the County Auditor cannot certify the grant revenues in accordance with Texas Local Govt. Code 111.043.  As a result, the grant budgets cannot be adopted and HCD make provision for administrative salaries and costs in anticipation of the award.

HCD requests that Commissioner’s Court approve a transfer of HCD’s General Funds in the amount of  $750,000 for CDBG, $250,000 for HOME and $200,000 for ESG temporarily for administrative costs into next fiscal year’s grant fund projects (Fund 2601) until such time that the County Auditor has the necessary documentation to certify receipt of funding based on HUD’s award letter.  Once the County Auditor certifies receipt of HUD’s funding, HCD requests that Commissioners Count approve reallocation of the funds to grant discretionary and required match, Fund 2699 so that adequate provision and resources are in place for the administration and operation of these entitlement programs.

In accordance with procedures prescribed by the Harris County Auditor’s Office (procedure G.7), costs of administering federally funded programs in excess of the administrative funds provided by the agency is defined as “Discretionary Match”.  Required match is defined as the amount of funds the County is required by contract or applicable laws and regulations with the granting agencies to expend on a grant program.  In order to account for these matching funds, grantee departments must transfer from its budget the estimated amount of match needs to FUND 2699 (Grant Match).

Expected Impact:

Without the transfer, the department will not be able to incur costs associated with the grants programs in accordance with prescribed policy and procedures. $1,200,000 General Funds moved to Programs.

Alternative Options:

Termination of the provision of discretionary and required match and administration of the entitlement grant programs.
