title

Transmittal by the Office of Management and Budget of an assessment by the Texas Department of Insurance that designates Harris County’s self-insured workers’ compensation program as a High Performer for 2024.

Background and Discussion:

The Texas Department of Insurance, Division of Workers’ Compensation (DWC) is required to monitor compliance with the Texas Workers’ Compensation Act and DWC rules. Section 402.075 of the Texas Labor Code mandates DWC to, at least biennially, assess the performance of insurance carriers and health care providers. The assessment includes the timely payment of temporary income benefits, timeliness of processing initial medical bills, timeliness of processing requests for reconsideration of medical bills, and timeliness of submission of initial payment and medical bill processing data electronically.

Based on the performance assessment, insurance carriers and health care providers are placed into regulatory

tiers: poor performers, average performers, and high performers. Harris County received the designation of “High Performer” attaining an overall score of 100.

Expected Impact:

Besides public recognition, a “High Performer” designation provides Harris County’s self-insured workers’ compensation program certain incentives such as limited audits and reduced penalties for non-compliance issues.
