Background and Discussion:
Such agreement will require that Lakeside Place PFC agree to the following: (i) to comply with all State and local laws and regulations relating to public facility corporations, (ii) to include, for each rent and income restricted unit, the Tenant Protections in each lease, in substantially similar form to the attached standard Tenant Protections for Harris County, (iii) the mutual execution and recordation of a Regulatory Agreement restricting the use of the property for affordable housing for a period of ten (10) years.
Pursuant to Chapter 303 Local Government Code (303.042c), and 303.0421(b)(3), the Lakeside Place PFC is required to provide written notice to the Presiding Officer of the Governing Body informing the jurisdictions of a planned development of The Oaks at Fall Creek Apartments. The County Attorney’s Office has reviewed the request. The new workforce housing development will receive an exemption from HCAD for the PFC with a land use regulatory agreement providing for the income targeting described below. The development is located at 9310 North Sam Houston Parkway East, Humble Texas 77396, Precinct 1, and consists of 357 total units, with 30% of the units targeted to households at 80% of area median income (AMI), 20% targeted to 60% of area median income (AMI), and 50% market rate units. The percentages of lower to moderate income units in the development exceed the requirements under Chapter 303 that provide for 10% of the units at 60% AMI, and 40% of the units at 80% AMI.
Expected Impact:
The approval of The Oaks at Fall Creek Apartments will create 357 new workforce housing rental units in northeast Harris County, with 179 units serving low-to-moderate income households at the construction completion, and provide for a land use regulatory agreement by the Lakeside Place PFC.
