Request by the Commissioner of Precinct 3 for discussion and possible action to create regulations on Panhandling and Roadside Vending in Unincorporated Harris County.

end

Background and Discussion:

In accordance with Texas House Bill 2012 (HB 2012), Harris County has the authority to regulate roadside activities-including panhandling, vending, and solicitation-within unincorporated areas to promote public safety and reduce traffic hazards. Unregulated roadside panhandling and informal vending can create safety risks for motorists and pedestrians, impede traffic flow, and impact community quality of life.

Expected Impact:

The Commissioners Court requests that the County Attorney work with court offices to draft an ordinance regulating roadside panhandling and vending activities in unincorporated Harris County, which may include:

1.                     Clear prohibitions on panhandling and vending within traffic lanes, medians, and other areas that pose safety risks.

2.                     Designated safe zones for solicitation and vending away from high-traffic areas to protect public safety while respecting individual rights.

3.                     Enforcement provisions that prioritize warnings and referrals to social services for individuals experiencing homelessness or economic hardship, emphasizing compassionate solutions.

4.                     Collaboration with Harris County Flood Control District, Harris County Sheriff’s Office, and local community organizations to support outreach and assistance programs.

5.                     Regular review and reporting on the ordinance’s effectiveness and community impact.

This ordinance aims to balance public safety concerns with humanitarian considerations by creating a regulated framework for roadside activities that respects individual rights and supports vulnerable populations.
