Background and Discussion:

Burnett Bayland Park is in Harris County Precinct 4, on the west side of Houston, within Beltway 8 loop.  The park sits at the intersection of Gulfton Street and Chimney Rock Road, bounded by Gulfton Street to the north, Chimney Rock Road to the east, Alder Drive to the west, and an extended park area to the south.  Covering approximately 40 acres, Burnett Bayland Park serves as a signature destination for Precinct 4 and will feature a new community center, event lawn, playground, multi-purpose courts, soccer fields, and additional amenities. The Phase 1A.1 Landscape Package includes the construction of a community garden, boardwalk, pedestrian bridges, soccer fields and pitches, and shaded structures.

This change consists of adjustments to existing bid item quantities and the addition of new bid items to the contract.  These modifications result in no increase to the current contract value and no extension to the contract duration.  The intent of these adjustments is to ensure the project is completed in accordance with the original scope and design requirements.

The change in contract includes the following:

PCO #19                     Bleachers at shade structure                                          Cost: $22,832.10                                          Time: Zero Days

The Precinct has requested the addition of bleachers at the FSS shade structures as part of the mini soccer pitch. The bleachers will provide seating for parents, coaches, and visitors, while keeping spectators off the playing field for improved safety and organization.

•                     Add New Line Item:
Item #140 Furnish and Install Bleachers at FSS Shade Structures:
2 EA × $11,416.05 = $22,832.10

PCO #20 - Planting - (RFI - 30)                                                                                    Cost: ($33,046.86)                                          Time: Zero Days

Quantity underruns are applied to balance new quantity items, aligning the contract with actual installed quantities and reducing overall cost impacts.  [Total Credit: ($33,046.86)]

Quantity Adjustment:

•                     Decrease Item #54 - TD Taxodium Distichum:
$1,486.52 × (13 EA) = -$19,324.76

•                     Decrease Item #54 - TD2 Taxodium Distichum:
$392.06 × (35 EA) = -$13,722.1

PCO #21 Brick Pavers at community garden                                          Cost ($9,478.98)                                          Time: Zero Days

Quantity underruns are applied to offset new quantity items to reflect actual installed quantities and minimize overall cost impacts to the contract. [Total Credit: ($9478.98)]

Quantity Adjustment:

•                     Decrease Item #8 - H.4 Pedestrian Rated Concrete Unit Pavers (Incl. Sub-slab):
$27.22 × (589 SY) = -$16,032.58

•                     Increase Item #9 - H.5 Truncated Dome Pavers:
$25.60 × 256 SF = +$6,553.60

PCO #22 Shade Structure Lighting Variance                                          Cost: $92,791.00                                          Time: Zero Days

The lighting schedule and electrical drawings were not available at the time the contractor was asked to provide pricing.  Once the plans were finalized, the required lighting fixtures and associated electrical work resulted in a significant cost increase.  The total value rose from $189,420.00 to $418,211.00, reflecting an increase of $228,791.00.  However, $136,000.00 had already been incorporated into the pricing after the original bid. This results in a remaining delta of $92,791.00 ($228,791.00 - $136,000.00), attributable to the additional lighting and electrical scope.  The Precinct is aware of the price change and has approved this additional cost.

Add New Bid Item:

•                     Item #139 Cost variance for lighting fixture and electrical work:

1 LS = $92,791.00

PCO #25   Stainless Steel Ceilings                                                               Cost: $141,750.00                                          Time: Zero Days

Stainless steel ceiling assemblies were not included in the Contractor’s initial estimate due to the lack of a vendor quote at the time, resulting in an additional cost beyond what the Precinct originally approved.  The addition includes two (2) stainless steel ceiling assemblies at each project entrance, with a lump sum cost of $141,750.00 for furnishing and installation.  Although this work is associated with Bid Item #132 (Gateway / Shade Structures Along Perimeter of Park), it was not included in the original estimate.  To account for this scope, a new Bid Item #132B (Stainless steel ceilings) will be established under Bid Item #132 through a Change Order.  The associated cost has been reviewed and approved by the Precinct.

Quantity Adjustment:

•                     Add New Line Item #132B Stainless steel ceilings:

1 LS = $141,750.00

PCO #26 Bid Item #133 Allowance for Artist -Quantity Adjustment:  Cost: ($215,000.00)                     Time: Zero Days

Bid Item #133 - Allowance for Artist / Art - Final Design was established as a lump sum allowance in the amount of $500,000.00 (LS) and currently remains largely unused, with the remaining balance available for allocation.  It has been approved to reduce Bid Item #133 from 100% LS ($500,000.00) to 57% LS ($285,000.00).  This reduction will be used to offset the additional change order costs totaling $214,847.16, resulting in no net increase to the contract amount.  This adjustment effectively neutralizes the impact of the listed PCOs by reallocating available allowance funds within the contract.

Quantity Adjustment:

•                     Decrease Item # 133 Allowance for artist / art - final design, locations, etc :

$500,000.00 x (43%) = ($215,000.00)

Expected Impact:

The proposed park reconstruction will reshape the area into a more inviting, efficient, and resilient space that strengthens community ties and delivers lasting value to the surrounding Harris County neighborhood.  This change enables the adjustment and addition of items to the contract, ensuring the project aligns with the original intent and complies with precinct requirements.

Alternative Options:

The County may choose to either approve or deny the change.  If it is not approved, the project will not be completed as intentionally designed.
