title

Request for approval of an Order issuing a limited delegation for the Executive Director of Harris County Housing & Community Development to approve & execute certain amendments to contracts between Harris County and the Texas General Land Office, pursuant to certain limitations.

Background and Discussion:

Housing & Community Development (HCD) and the County Attorney’s Office have worked together in collaboration to propose this limited delegation of authority to the Executive Director of Harris County Housing & Community Development to approve & execute certain amendments to contracts between Harris County and the Texas General Land Office, pursuant to the limitations below:

a)                     The documents must be amendments only (not new agreements) to contracts regulating or providing terms and conditions of the CDBG-DR and/or CDBG-MIT grant awards issued to Harris County;

b)                     The amendment(s) must not increase the scope of work on a cumulative basis beyond the work currently identified for the CDBG-DR and CDBG-MIT awards to both Harris County and Harris County Flood Control District;

c)                     The amendment(s) must not decrease the grant awards on a cumulative basis below the cumulative CDBG-DR and CDBG-MIT awards issued to both Harris County and Harris County Flood Control District;

d)                     The amendment(s) must not decrease the term of either the CDBG-DR or the CDBG-MIT grant to Harris County; and

e)                     The amendment(s) must not obligate the County to expend any additional funds.

Any amendments executed pursuant to this delegation must be provided to Commissioners Court as a transmittal as soon as possible following its execution.

This approval will support HCD and partners with further reduction in delays when executing CDBG-DR and CDBG-MIT contract amendments. For these types of items, Harris County agencies and partners in these programs cannot move funds and draw on certain projects until the amendments get final approval (which, up until now, have not been able to occur until after commissioners court authority to execute). This is especially important as all Harris County partners are working closely as one team to ensure funding sources are maximized promptly within applicable deadlines. The aforementioned limitations provide legal and practical safeguards that suit these purposes but prevent and are not intended to be a broad delegation of authority.

Expected Impact: No fiscal impact.

Alternative Options: Without this approval, executive and effective implementation of various amendments will continue to be delayed or otherwise depend upon Commissioners Court agendas.
