Background and Discussion:

Harris County has asserted its statutory subrogation rights as a Workers’ Compensation insurer to recover benefits paid on behalf of its employee, Ann Glasgow McCall, who was injured in an automobile accident with while in the course and scope of her employment with Harris County Constable Precinct Seven on April 18, 2021.  Harris County paid $43,961.27 in workers compensation and salary continuation benefits. The only available liability insurance policy providing coverage for Defendant, Saul Ortega, is a $30,000.00 limits policy through Safeco Insurance.   An order authorizing Harris County’s settlement of its claims is attached for use by the Court if the Court decides it would be in the best interest of the county to settle the County’s claims against Saul Ortega.
