Background and Discussion:

Chapter 155 of the Local Government Code allows Commissioners Court to authorize a payroll deduction from employees’ wages or salary for:

•                     payment to a credit union;

•                     payment of membership dues in a labor union or a bona fide employees association;

•                     payment of fees for parking in a county-owned facility;

•                     payment to a charitable organization;  or

•                     payment relating to an item if Commissioners Court determines that the payment serves a public purpose.

Chapter 155 states that public funds may not be used to pay the administrative costs of making a deduction, except for a deduction relating to the payment of parking fees in a county-owned facility. The organization for whose benefit a deduction is made must pay any administrative costs for making the deduction. The Auditor’s Office calculates the administrative costs and subtracts it from the employee deductions sent to the organization. There are not enough employee deductions to offset the administrative costs for United Way of Baytown Area; therefore, it is recommended that Harris County execute the termination clause of the agreement.

Expected Impact:

There are three employees contributing $7.50 per pay period to United Way of Baytown Area, but the entire amount is being offset by Harris County’s administrative costs.
