title
Request for approval of two memoranda of agreement with the Department of the Army, in the amount of $20,000 each, for the Undertaking of Federal Activities Relating to the Solutions for Adaptive Flood Mitigation Equitably Empowering Resilient Communities Section 203 Study and for the Provision of Inherently Governmental Functions and Technical Assistance Relating to the Solutions for Adaptive Flood Mitigation Equitably Empowering Resilient Communities Section 203 Study. (Project ID Z100-00-00-P044, Agreement Nos. 2024-25 and 2024-26, Countywide).

Background and Discussion:
The Solutions for Adaptive Flood Mitigation Equitably Empowering Resilient Communities (SAFER) Study is a new feasibility study that the FCD will be initiating and following Section 203 of the Water Resources Development Act (WRDA) of 1986 as amended by Section 161 of the Water Resources Development Act of 2020 (33 U.S.C. § 2231). Two separate memoranda are required for the FCD and USACE to negotiate scope of USACE involvement in the 203 study as well as associated costs:
- Conducting model review and approval, as well as NEPA and planning process compliance
- Providing guidance and technical assistance to the FCD on the study
Approval of these memoranda will allow the Flood Control District to conduct a feasibility study that follows federal processes and guidelines for flood mitigation planning studies and provide the opportunity for HCFCD to seek federal funding that wouldn’t otherwise be available. The study will take into consideration the comprehensive benefits of solutions under evaluation while considering economic, social, and environmental quality benefits.
Expected Impact:
The MOAs between USACE and the Flood Control District are required for USACE to provide inherently governmental functions and technical and policy guidance related to the SAFER Study, and to coordinate with each other.
Alternative Options:
The alternative would be to not utilize USACE for required governmental assistance and technical guidance, which would impact the successful completion of the study and the associated review of the final deliverables, and potentially prevent the Flood Control District from seeking federal authorization through the Section 203 process for flood mitigation alternatives that are to be evaluated during the SAFER Study.
