Request for approval to self-insure the bond requirements in lieu of purchasing bonds for certain Harris County officials and employees in accordance with the Texas Government Code and Local Government Code.

Background and Discussion:
Section 88.008 of the Texas Local Government Code allows a county officer or employee to perform the duties of the office or employment without executing a bond if Commissioners Court by order authorizes the county to self-insure against losses that would have been covered by the bond, and the County Judge approves the order if the County Judge was required to approve the bond under another law. It is recommended to self-insure the bond requirements for the offices of County Commissioner (including Ex-Officio Precinct Road Supervisor), County Judge, County Attorney, County Auditor, Constable, Sheriff, District Attorney, Purchasing Agent, Justice of the Peace, and County Civil Court at Law Judge.
It is also recommended to self-insure the bond requirements of Deputy Clerks and employees of the District Clerk and County Clerk as allowed by Section 51.309 of the Texas Government Code and Section 82.002 of the Texas Local Government Code as well as Assistant Treasurers, Deputy Treasurers, and all other employees of the County Treasurer as allowed by Section 83.008 of the Texas Local Government Code.
Finally, it is recommended to self-insure the bond requirements of Reserve Deputy Constables and Reserve Deputy Sheriffs as allowed by Sections 85.004 and 86.012 of the Texas Local Government Code.
Upon approval, the order will be kept and recorded by the County Clerk.
