title

Request for approval of a Memorandum of Understanding (MOU) with Harris County Toll Road Authority (HCTRA) in the amount of $581,268.85 for Minority- and Women-Owned Business Enterprise (M/WBE) and Prevailing Wage Program Compliance Services provided during FY2026 under Texas Government Code §2258.

end

Background and Discussion:

The Department of Economic Equity and Opportunity (DEEO) Business Assistance team provides program compliance services for HCTRA projects in accordance with the Harris County Minority- and Women-Owned Business Enterprise (M/WBE) Policy. Further, the Worker and Community Protections (WCP) team provides prevailing wage services in accordance with Texas Gov’t Code §2258.  The parties agree to a formal MOU for payment for services upon execution by all parties.

This MOU is for FY2026; the period of performance runs from October 1, 2025, to September 30, 2026. The amount and terms have been mutually agreed upon and include labor costs for five and a half (5.5) positions (PCN) and project costs such as compliance software, supplies, and related expenses. The amount will be reviewed annually to consider additional projects and updated as needed.

Expected Impact:

This action maintains an existing interdepartmental partnership and advances the County’s equity and vendor diversity goals. The DEEO will use the revenue collected under this agreement to secure the resources required to ensure compliance with the M/WBE and WCP program on HCTRA projects in accordance with the Harris County M/WBE Policy and Texas Gov’t Code §2258.

Alternative Options:

If the MOU is not approved, DEEO would not have a formal agreement to provide M/WBE and wage monitoring compliance services to HCTRA, which could result in a gap or disruption in compliance oversight for toll road projects.
