Background and Discussion:
The provision for dedicated positions with the U.S. Army Corps of Engineers (USACE) Galveston District is under the referenced Memorandum of Agreement with the Flood Control District to expedite wetland verifications, jurisdictional determinations, and permitting requests submitted by the Flood Control District to the USACE. This funding request is similar to previous approved requests, which allows USACE to fund full-time staff to support the increased number of projects that are currently pending USACE review and that are anticipated for future submittal associated with the ongoing HCFCD Bond Program and the Community Development Block Grant Program (CDBG) projects.
Under a Memorandum of Agreement with the Flood Control District (approved in Commissioner’s Court on December 23, 2008), as authorized by Section 214 of the Federal Water Resources Development Act of 2000 (“WRDA 2000”), as amended, the parties were authorized to fund dedicated positions for future fiscal years. Commissioner’s Court previously approved continued funding in June 2023, which is now nearly completely spent. The service to expedite requests for regulatory review has proven beneficial to the Flood Control District. Therefore, it is recommended that Commissioner’s Court authorize funding for dedicated positions with the USACE Galveston District and continue with the Memorandum of Agreement.
Expected Impact:
Approval of funding request to continue with the Memorandum of Agreement that will allow Flood Control District permits to be expediated for review by the USACE, Galveston District.
Alternative Options:
The alternative would be to not fund these positions at the Galveston District, which would slow processing and review times for the majority of Flood Control District projects and therefore slow project implementation.
