Background and Discussion:

The Harris County Housing and Community Development Department (HCD) made a recommendation to Commissioners Court to create a Public Facility Corporation related to affordable housing which was approved on November 11, 2025.

Nominations for Directors of the Harris County Public Facility Corporation (HCPFC) have been confirmed by HCD and are subject to County Commissioners’ Court approval. There are at least three elected officials nominated to the Board in compliance with the draft Articles of Incorporation. The attached Articles of Incorporation and By-laws also need County Commissioners’ Court approval.

HCD is proposing that it initially staff the newly created HCPFC.  At a future meeting of the HCPFC an interlocal agreement similar in nature to the interlocal between Harris County and the Harris County Housing Finance Corporation will be presented for consideration of the Board.  In the interim there will be some start-up costs for which HCD has identified funds which can be used for this purpose. HCD requests authorization to transfer up to $25,000 to the HCPFC to cover these initial costs.

Expected Impact:

The fiscal impact is a $25,000 transfer of existing local funds from account 2402 to establish a bank account for the HCPFC and payment of start up expenses.  No further additional local funds are anticipated for future HCPFC expenses.

Commissioners’ Court adopted the recommendation that the HCPFC starts with a pilot program of no more than 5 PFC transactions, then assess and report back to Commissioners’ Court with recommendations for future program design. The HCPFC would support the creation of hundreds of units of affordable housing with these first 5 projects and generate more than sufficient revenue to cover its ongoing operating costs.
