Request for Commissioners Court to adopt the 2027 Constable Service fees.

Background and Discussion:

The County last updated constable service fees for calendar year 2025 but left them unchanged for 2026.  Since the fees were last updated, the salary and benefits cost of a deputy has increased 32% with an additional 8% average increase planned for FY27.  Consistent with a Court directive on August 17, 2026, the Office of Management and Budget (OMB) recommends an increase to the evictions-related fees but is not recommending changes to the non-eviction fees at this time.  Pursuant to Local Government Code 118.131, OMB recommends Commissioners Court adopt the attached 2027 Constable Service Fee Schedule and provide written notice of

the fee amounts to the State Comptroller by October 15, 2026.

In-line with the officer salary increases since the fees were last updated, the recommended 2027 Fee Schedule includes a 41% increase for the following eviction-related fees: Forcible (Eviction) citation service fee ($85 to $120); Writ of Possession ($155 to $219); Writ of Reentry ($155 to $219) and Writ of Restoration of Utility Service ($155 to $219).  Of note, the fee amounts for these three writs are all the same as required by Texas Property Code 92.009 and 92.0091.

Expected Impact:

OMB estimates the revised fees will generate about $5M more annually.

Alternative Options:

By statute, any changes to Constable Service fees for the upcoming calendar year must be adopted by October 1.  If the recommended fees are not adopted, fees will remain unchanged for 2027 and the higher revenue will not be realized.
