title

Request by the Toll Road Authority for approval to adopt a HCTRA Emergency Service Response Reimbursement Policy to allow for reimbursement of emergency services provided on the HCTRA tollway system.

Background and Discussion:

The July 10, 2025 Commissioners Court requested HCTRA to develop a policy for HCTRA to enter into agreements with local municipalities, local law enforcement, local fire, and or local emergency service departments (collectively “Responding Agency”) and offer reimbursement based on rates established by the Federal Emergency Management Agency (FEMA) for such services on the HCTRA tollway system.

The proposed policy includes a template for an Interlocal Agreement (ILA) that establishes reimbursement opportunity for the various external municipalities, fire departments, and emergency service departments, which provide services for incident response on HCTRA tollway system when dispatched by the authorized communications center.  The services identified for reimbursement in an ILA may include the following services: fire protection and suppression, rescue and extrication, hazardous materials mitigation, and incident command and scene management.  The purpose of the ILAs with external Responding Agencies is to provide reimbursement for eligible response costs to those agencies that provide fire and rescue incident response on the HCTRA tollway system.

The proposed policy also includes provisions for entering into memorandum of understandings with participating Harris County Constable agencies and Harris County Sheriff’s office for providing law enforcement services on the HCTRA tollway system.  Reimbursements for these services are included in the annual county budget process.

Expected Impact:

Approval of the policy will provide HCTRA with the parameters for offering a reimbursement opportunity to the existing external Responding Agencies and to establish formal MOUs with Harris County law enforcement agencies.

Alternative Options:

An alternative option is to not adopt the proposed policy and continue as it is today.
