Background and Discussion:

Harris County Municipal Utility District No. 368 (MUD 368) owns and operates water and sewer facilities along Hufsmith-Kohrville Road, including within the section of roadway between 700' north of Ezekiel Road to approximately 400' north of Boudreaux Road.  MUD 368 also owns a sanitary sewer easement along the section of roadway.  Harris County and MUD 368 will need to enter into an agreement to permit Harris County to include the relocation of MUD 368’s utilities in the Harris County roadway project.  Additionally, the agreement will permit Harris County to construct and maintain sidewalk that falls within MUD 368’s sanitary sewer easement.  MUD 368 will maintain the utilities after the Harris County roadway project construction is complete.  MUD 368’s payment to the County for the construction of the utility relocations will be due in FY 2026.

Expected Impact:

The interlocal agreement between Harris County and Harris County Municipal Utility District No. 368 will ensure that the design, advertise to bid, award for construction, construction management and financial responsibilities for both parties is properly outlined.

Alternative Options:

If no action is taken, Harris County Municipal Utility District No. 368 water and sewer facilities will remain underneath and within the limits of the proposed pavement, which could result in maintenance concerns for the roadway.
