Background and Discussion:

Request for approval to renew a cell tower lease agreement located at 5200 S. Willow Drive, Houston, Texas 77035, along HCFCD Unit D512-01-00.  The property was originally leased under an agreement between the District and Voicestream Houston, Inc. (“Voicestream”) for the period of May 1, 2003, to April 30, 2013, with two optional five-year renewals.  The lease was later acquired by T-Mobile West Tower, LLC (“T-Mobile”) from Voicestream.  The first renewal option, as specified in the Original Agreement No. 312 and its Amendment, extended the lease to April 30, 2018.  The second renewal option was also exercised, officially extending the lease until its expiration on April 30, 2023.  T-Mobile desires to continue to use the property for the purpose of operating a telecommunications facility, specifically a cell tower.  The Flood Control District has determined that the renting of such property will not interfere with the use of the property for flood risk reduction purposes.

Expected Impact:

This cell tower lease agreement will allow T-Mobile to use a portion of Flood Control District’s property for telecommunication purposes in accordance with the terms of the Lease Agreement.

Alternative Options:

The alternative to approving this Lease Agreement would be to discontinue leasing the Flood Control District’s property for telecommunication purposes.  This would result in T-Mobile being required to surrender the rented property and restore it in good condition as received, excepting ordinary wear and tear.
