Background and Discussion:

In November 2023, the Commissioners Court executed an agreement for both the CDBG-DR program (24-033-000-E072) and CDBG-MIT program (24-064-000-E151) including spending milestones and requested recurring updates on both programs.

On October 8, 2024, the Flood Control District provided its most recent status update on the CDBG program highlighting initiatives, priorities, regulatory uncertainties, and related lifecycle project impacts. As previously presented projects have progressed, certain projects have been found to no longer be viable, which requires approval by Commissioners Court of an updated project list. Replacement projects were identified by using the same methodology as the original list - either by selecting alternative projects (i.e., “below the funding line” projects) or focusing on project schedule and environmental readiness as two key metrics for selection.

Additional modifications to the project list are also being made to streamline project delivery by combing certain projects, as well as reflect updated project costs in some instances.

As noted in prior requests for court action:

•                     Recent history has highlighted that the planning of any substantial project must consider the near certainty of supply chain difficulties, labor shortages, environmental considerations, and impacts from extreme weather events. Encountering any one of these factors on a project could have significant impacts on completion of individual projects, and on the overall administration of the program.

•                     The project list will likely evolve based on project eligibility review by GLO, project schedules and project cost. Project dollars are estimates based upon today’s dollars and could change as projects advance through the project lifecycle. It is also possible that projects develop fatal flaws that could impact project delivery so alternative projects are being proposed in case they are needed to substitute for a project that becomes non-viable. Due to the accelerated timeframe for project delivery, every opportunity to shorten project delivery is needed to be able to utilize all funding within the deadline.

Expected Impact:

Approval of this item will allow the Flood Control District to apply for CDBG partnership funding for flood risk reduction projects and meet Harris County and GLO requirements of program schedule and spending milestones.

Alternative Options:

The alternative is to not approve this court item and potentially exceed the programmatic deadline and default on spending milestones.

County Strategic Plan Goal:  2. Connect our community with safe, reliable, equitably distributed, and well-maintained infrastructure.
