Request for approval for County of Harris, a body corporate and politic of the State of Texas to convey real estate to Bayer Investments LLC, for tract 6, a 3.7374-acre tract of land for the Precinct 3 Non-Project Related Tasks project and that the County Judge execute the Deed Without Warranty as settlement for litigation pending under Cause Number 2024-19591 in the 334th District Court of Harris County, Texas, UPIN 23103MF2Q801, Precinct 3.

Background and Discussion:
A Right-of-Way Deed conveying a 60-foot right-of-way interest to Harris County was recorded on October 24, 2000, by the then property owners. Extensive searches by the Real Property Division and the applicable precincts found no evidence the County ever accepted the conveyance or intended to accept, retain, or create a legal right of ownership to the County. The recorded interest has created a cloud on title for which the County’s cooperation is needed to cure and led to litigation for removal of the cloud on title in the above referenced cause number.
A negotiated resolution was reached where the County will convey its interest via Deed Without Warranty to cure the clouded title, and the Plaintiff will grant dedicated easements for ingress, egress, and utilities to six properties abutting the private road who had only a prescriptive easement, consistent with the supporting materials. Further, the Plaintiff will nonsuit its lawsuit against the County.
This court letter and associated procedure have been reviewed and approved by the County Attorney’s Office as necessary and appropriate.
Expected Impact:
Approval will authorize conveyance of the County’s recorded interest, cure the cloud on title, support settlement of the litigation, and secure dedicated access and utility easements for adjacent tracts.
