title

Request for approval of an agreement with the Texas Commission on Environmental Quality (TCEQ) Occupational Licensing and Registration Division (ORLD) to provide the department with basic, view-only regulatory user access to the Resource Conservation and Recovery Act database, RCRAInfo, for vital data to facilitate industrial solid waste and hazardous waste compliance investigations under Harris County’s jurisdiction.

Background and Discussion: The US EPA maintains the Resource Conservation and Recovery Act database, RCRAInfo. The public can access certain information in RCRAInfo 90 days after entry into RCRAInfo. EPA provides approved state hazardous waste programs regulatory user access to RCRAInfo which allows authorized states to access information in RCRAInfo immediately and before it is available to the public. TCEQ staff has regulatory user access to RCRAInfo as the agency that administers Texas’ approved hazardous waste program. The Registration and Reporting (R&R) Section of the TCEQ Occupational Licensing and Registration Division oversees access to RCRAInfo.

Expected Impact: TCEQ R&R Staff will respond to PCS requests to add or remove individuals from access.

PCS will access and utilize information from RCRAInfo only as an investigative tool for persons and facilities under Harris County’s jurisdiction and only for active investigations. PCS will ensure the integrity of its use of the RCRAInfo database. The PCS Compliance section will strictly maintain PCS’ access to RCRAInfo. PCS understands that RCRAInfo account access is provided for the named employees only, that sharing of access is strictly prohibited, that access from the TCEQ is conditional and a privilege, and that access may be terminated if misused.

This agreement will go into effect upon approval by Harris County Commissioners Court, as of the date of the signature of the Harris County Judge. TCEQ and Harris County will renew this protocol no later than December 31, 2028, and every five years thereafter. This agreement will expire if not renewed.
