Background and Discussion:

The Flood Control District and Generation Park Management District (GPMD) entered into an interlocal agreement (Agreement No. 2018-95) to allow for GPMD to repair the Flood Control District Facilities (P127-00-00, P127-03-00 and P527-01-00), construct recreational amenities, and maintain the Flood Control District Facilities, Channel Amenities and Property; in exchange, Flood Control District and the County will convey their fee simple property and assign their drainage easements for P127-00-00, P127-03-00 and P527-01-00 to GPMD.  Flood Control District agreed to provide funding to GPMD to repair the Facilities to meet current Flood Control District standards.  In accordance with Section 2.01 of the agreement, Flood Control District inspected the Facilities and provided a written report and price to GPMD indicating all necessary Improvements to restore and improve the Facilities to make them in compliance with Flood Control District standards for drainage and storm water channels.  GPMD reviewed the Report and provided comments to Flood Control District stating which proposed repairs are required and which repairs are not required due to future GPMD projects along the Facilities. The original amount requested for approval was ($920,460.00) to be paid by Flood Control District to GPMD for the design and construction of the Improvements to the Facilities in accordance with Section 2.02 of the Agreement. This amendment to the agreement is payment in the amount of $79,798.18 to GPMD as owed differential.

Expected Impact:

Complete payment of outstanding balance.

Alternative Options:

The alternative to approving this item would be for Flood Control District not to make payment as per the agreement, which would result in a breach of the agreement.
