Request Summary (Agenda Caption):
title
Request for approval to provide additional funding to the United States Army Corps of Engineers, Galveston District in an amount not to exceed $150,000 for a dedicated position to expedite permit reviews and to continue with a Memorandum of Agreement (MOA) executed April 13, 2010, Countywide.
end
Background and Discussion:
Office of County Engineer (OCE) and the Galveston District of U.S. Army Corps of Engineers entered into an agreement consistent with the Water Resources Development Act (WRDA) where upon OCE can provide funding for a position at the U.S. Army Corps of Engineers - Galveston District to prioritize and expedite reviewing our Clean Water Act permit applications and jurisdictional determination requests countywide.
Expected Impact:
As a result of the agreement, and the utilization of a dedicated reviewer we can expedite OCE Project permitted through our Regional General Permit or through the Nationwide Permit requires 45-60 days to complete, standard permits or Individual permits can be completed between six (6) months and a year, and Jurisdictional determinations can take as little as 30 days for projects with minimal or no waters of the U.S. within the project limits, and up to 6 months, or a little longer, for more complex projects requiring extensive review by the USACE.
Alternative Options:
Non-funding option would result in the loss of utilizing a dedicated review for OCE projects. Our projects being placed in the general que for review within the respective section of the Regulatory Division of the USACE-Galveston District and would result in following: projects seeking an approved jurisdictional determination within the Compliance Branch would require nine (9) months to a 18 months for review and a determination letter issued; for projects requiring permitting through the Evaluation Branch would require 3-6 months for regional general permit or nationwide permit review and authorization and project requiring standard permit (individual permit) would require 1 year minimum (most likely 18 months to 2 years) for authorization to proceed with the project.
