Background and Discussion:

Burnett Bayland Park is in Harris County Precinct 4, at the intersection of Gulfton Street and Chimney Rock Road. The park is bounded by Gulfton Street to the north, Chimney Rock Road to the east, Alder Drive to the west, and an extended park area to the south. Covering approximately 40 acres, Burnett Bayland Park currently features a skate park, walking trails, a community center, play areas, and basketball courts. The proposed improvements include an inclusive playground, detention basin, even lawn, multi-purpose courts, soccer fields, gaming and seating areas, rain gardens, restrooms, and pavilions, further enhancing the park’s amenities and community appeal.

The change involves adjusting existing bid item quantities and adding new items to the contract, increasing the current contract value by $640,592.00 and 7 days to ensure the project is completed as originally intended.

PCO #1    Chain Link Security Fence Concerns - (RFI - 4):      $148,842.5

There is ongoing concern about public trespassing into the Phase 1A.1 construction area through the existing 4-foot chain-link fence along both the westbound and eastbound sides of the project at Alder Drive and Chimney Rock Road. Although the gates in these areas remain closed, members of the public are climbing over the low-height fence and entering the active construction zone, often in close proximity to operating heavy equipment. This creates significant safety risks for both the public and the contractor’s crew.

To mitigate this issue, Precinct 4 has approved the installation of a 6-foot chain-link fence alongside the existing 4-foot fence to help deter unauthorized access.

Change in contract includes the following:

Quantity Adjustment

Increase Item #36 Existing fence and gates (chain link fence) by 1300LF @ $5.75/LF = $7,475.00

Increase Item #137 chain link fence (6 ft height) with pedestrian gates by 2745LF@ $51.50/LF = $141,367.5

PCO #2     Skate Park Security Fence - (RFI - 7):     $24,256.50

Precinct 4 has requested additional fencing around the skate park due to people climbing over the site fence and using the park while it is still within the construction zone.

Change in contract includes the following:

Quantity Adjustment:

Increase Item #137 chain link fence (6 ft height) with pedestrian gates by 471LF @ $51.50/LF = $24,256.5.

PCO #3 Polypropylene Pipe Pay Items Adjustment -(RFI -22&6):  $337,726.25-$27,169.75= $310,556.50

During the bid process, the contractor misinterpreted the language in the bid tab for the alternate items. The term “add alt” was included, but Harris County does not add money to existing items. The pay items are all-inclusive, so there cannot be two separate payments for the same work.

After consulting with the County Attorney’s Office, it was recommended that we issue a change order to incorporate the correct pricing-combining the base cost with the additional amount for the replacement material. The original bid specified HDPE pipe, with Poly pipe listed as an optional material. Precinct 4 has elected to use Poly pipe.

To correct the pricing, we will deduct the incorrectly entered items from the purchase order and adjust the total contract amount accordingly. The contract currently includes $27,269.25 for the pipe, which will be transferred to the new items created for the Poly pipe, and the previous quantities will be zeroed out.

Change in contract includes the following:

Quantity Adjustment:

Decrease the following items: - $27,169.75

Item 138: Thermoplastic pipe (pp) (12 in)=   -120LF @ $21.5/LF =    - $2580.00
Item 139: Thermoplastic pipe (pp) (18 in) =   -1329LF @ $6.25/LF=  - $8306.25
Item 140: Thermoplastic pipe (pp) (24 in) =   -770LF @ $9/LF =         - $6930.00
Item141:  Thermoplastic pipe (pp)  (30 in) =  -308LF @ $21/LF =      - $6468.00
Item 142: Thermoplastic pipe (pp)  (30 in) =  -174LF @ $14.5/LF =    - $2523.00
Item 143: Thermoplastic pipe (pp)  (30 in) =  - 308LF @ $21/LF =      - $362.50

New Items: $337,726.25

Item 144 Thermoplastic pipe (pp) (12 in):  120LF @ $91.50 = $10,980.00
Item 145 Thermoplastic pipe (pp) (18 in).: 1329LF @ $79.75/LF = $105,987.75
Item 146 Thermoplastic pipe (pp) (24 in).: 770LF @ $106/LF =       $81,620.00
Item 147 Thermoplastic pipe (pp) (30 in).: 308LF @ $144/LF =       $44,352.00
Item 148 Thermoplastic pipe (pp) (36 in).: 174LF @ $161.50/LF = $28,101.00
Item 149 Thermoplastic pipe (pp) (42 in).: 174LF @ $383.25/LF = $66,685.50

PCO #4    Conflicting Water Line - (RFI - 13):   $156,936.50 and 7 calendar Days

The contractor has encountered an existing 6" water line running from the south end of the project near Alder Drive and tying into the community center’s fire line. This line lies within the proposed excavation area for the southern section of the detention basin, specifically along the planned slope. Excavation cannot continue because the line cannot be safely exposed under its current water pressure. The water line will need to be relocated to eliminate the conflict with the proposed detention pond.

Change in contract includes the following:

Quantity Adjustment:

Increase the following items: $15,810.00

Item 44 removing structures (plastic pipe): 1020LF @ 15.5/LF = $15,810.00

New Items: $141,126.83

Item 150:   6" waterline by Open Cut:  953LF @ $76.50/LF =          $72,904.50
Item 151:   Restrained joint offset:      124LF @  $286.49/LF =       $35,525.76
Item 151:   Waterline TS&V w/Plug:    2 EA    @ $16,348.62/EA = $32,697.24

Expected Impact:

The proposed reconstruction of the park will transform the park into a more inviting, practical, and resilient space that supports community interaction and delivers lasting benefits to the surrounding neighborhood within Harris County. The installation of the additional 6-foot fencing and skate park fencing will reduce unauthorized public access, lowering the risk of accidents involving heavy equipment. Improved site security may minimize liability exposure for both the County and the contractor.

This change enables the adjustment and addition of items to the contract, ensuring the project aligns with the original intent and complies with precinct requirements.

Alternative Options:

The County may approve or deny the requested funding. Without approval, the full intended functionality of the detention pond will not be achieved.
