Background and Discussion:

Pursuant to Tex. Loc. Gov't Code §262.0295(a) and §262.030(d), for any RFP contract submitted and included on this

request, submission shall constitute (1) a determination by the Purchasing Agent that it is impractical to prepare detailed

specifications for an item to support the award of a purchase contract, and (2) a notification to the commissioners court of

the same. If such letter is returned to Purchasing without alterations by commissioners court, that (3) shall constitute a

finding by commissioners court that it is impractical to prepare detailed specifications for that item to support the award of

a purchase contract, and the Purchasing Agent may use the multistep competitive proposal procedure, or an "RFP" as per

Tex. Loc. Gov't Code §262.0295 and §262.030.

The Harris County Toll Road Authority (HCTRA) currently partners with the Harris County Attorney’s Office (CAO) to provide in-house legal collection services for delinquent toll road transactions that occur within Harris County. The CAO has successfully performed these services since 2019, achieving performance that exceeds prior practices.

To support its broader role, HCTRA has entered into agreements with other toll road agencies across the State of Texas to centralize daily collection efforts statewide. Accordingly, HCTRA now seeks assistance with the collection of delinquent toll road transactions occurring outside the boundaries of Harris County, pursuant to those contracts.

The Harris County Attorney’s Office will continue to handle all collection efforts related to delinquent toll road transactions originating within Harris County.

Additionally, HCTRA will work with the Harris County Department of Economic Equity & Opportunity (DEEO) on the MWBE contracted goal once a scope has been finalized with the County Attorney’s Office.

Expected Impact:

Approval to advertise will allow for effective recovery of delinquent toll road transactions which occur outside Harris County, pursuant to related contracts, which is critical both to maintaining the liquidity of the toll system and to preserving public trust in HCTRA’s operations.  This RCA does not pertain to or impact the current collection partnership with the Harris County Attorney’s Office for the delinquent toll road transactions occurring within Harris County.

Alternative Options:

No other recommended solutions for this identified need.
