Background and Discussion:

Burnett Bayland Park is in Harris County Precinct 4 at the intersection of Gulfton Street and Chimney Rock Road. The approximately 40-acre park is bounded by Gulfton Street to the north, Chimney Rock Road to the east, Alder Drive to the west, and additional parkland to the south. Existing amenities include a skate park, walking trails, community center, playgrounds, and basketball courts.  The proposed improvements will enhance the park’s functionality and community appeal by adding an inclusive playground, detention basin, event lawn, multi-purpose courts, soccer fields, gaming and seating areas, rain gardens, restrooms, and pavilions.  This change includes adjustments to existing bid item quantities and the addition of new items to the contract.  These modifications result in a net increase of $34,617.20, ensuring the project is completed in accordance with the original design intent.

PCO #7 - Additional Pond Excavation and Clay Liner (RFI-30): $64,605.28

As part of the detention pond construction at Burnett Bayland Park, a clay liner is required to comply with Harris County Flood Control specifications.  Installation of the clay liner requires over-excavation of an additional 2 feet across the detention pond footprint, resulting in 9,542.04 CY of additional excavation.

Change in Contract:

Increase:

•                     Bid Item #82 - Excavation & Off-Site Disposal
+9,542.04 CY @ $32/CY = $305,345.28

To offset and minimize the overall cost increase, the Engineer of Record (EOR) recommends deducting quantities from unused existing bid items:

Decrease:

•                     Bid Item #88 - Detention Basin Excavation & Fill Clay Liner (2-ft)
−25,000 CY @ $4.60 = ($115,000.00)

•                     Bid Item #90 - Over-Excavation for Clay Liner & Off-Site Disposal
−25,000 CY @ $3.40 = ($85,000.00)

•                     Bid Item #130 - Imported Fill Clay Liner (2-ft)
−2,910 CY @ $14.00 = ($40,740.00)

•

Net Total: $305,345.28 − $240,740.00 = $64,605.28

These deductions reduce the net cost impact associated with the additional excavation required for clay liner installation.

PCO #8 - Existing Concrete Foundation Conflict (RFI-33): $5,316.30

An existing concrete foundation beneath the parking lot subgrade conflicts with the proposed work.  To address this condition, a 70' × 20' × 2' area must be over-excavated to remove the concrete foundation and surrounding brick debris.  This work will be completed using existing bid items, requiring quantity overruns to account for the additional material.  The Precinct approved the additional quantity request to keep work progressing.

Quantity Adjustments:

Increase:

•                     Bid Item #128 - Excavation (Special)
+53.7 CY @ $32/CY = $1,718.40

•                     Bid Item #129 - Borrow
+53.7 CY @ $67/CY = $3,597.90

Total Cost: $5,316.30

PCO #9 - 24-ft Roadway to Youth Center (RFI-34): −$101,805.84

Quantity underruns are applied to offset new quantity items, reflect actual installed quantities, and minimize the overall cost impact to the contract.  The Precinct and the Contractor concur with the proposed adjustments.

Quantity Adjustments (Decrease):

•                     Item #50 - Lime Treatment (8-in depth, 6% lime):                                          1,176.46 SY @ $6 = ($7,058.76)

•                     Item #51 - Lime (Commercial Lime Slurry, 6%):                                          19.62 TN @ $384 = ($7,534.08)

•                     Item #56 - Concrete Pavement (Class E, 7-in depth):                     1,047 SY @ $79 = ($82,713.00)

•                     Item #63 - Concrete Curb (6-in):                                                                                    750 LF @ $6 = ($4,500.00)

Total Credit: ($101,805.84)

PCO #10 - 3-Inch Force Main from Water Well to South Property Line (RFI-39): $7,936.25

Per direction received, the Contractor was requested to install a 3-inch force main from the water well to the south property line to service the future Phase II South Detention Basin.  The Precinct agrees with the proposed cost.  This price represents full compensation for all labor, materials, tools, and equipment required to complete the work.

New Bid Item:

•                     Item #155 - 3-Inch Force Main from Water Well to South Property Line:
125 LF @ $63.49/LF = $7,936.25

PCO #15 - RFI#013 - City of Houston Right-of-Way Infrastructure Scope - Phase 1A -: $58,565.21

The City of Houston package was originally separated to avoid delays associated with City of Houston permitting during the design phase.  However, it has been decided to incorporate this scope into a change order rather than bid it to a separate contractor, to prevent potential delays during bidding and construction.  The scope includes a water line, storm sewer at the outfall, and a driveway along Chimney Rock Road for the park entrance within the City of Houston and Right-of-Way.

New Bid Item
Item #53 - City of Houston Right-of-Way Infrastructure Construction: 1 LS = $390,627.81

Decrease to Existing Items
Item #3 - Relocate Existing Trees (see tree mitigation plan): -4 EA @ $29,600.00 = -$118,400.00

Item #26 - Tree #56 Live Oak (Arbor Lift, see tree mitigation plan): -0.808 LS @ $123,200 = -$99,545.60

Item #125 - Uniformed Law Enforcement Officer: -540 HR @ $78.00 = -$42,120.00

Item #137 - Chain Link Fence (6 ft height with pedestrian gate): -1,398 LF @ $51.50 = -$71,997.00

Total Decrease: -$332,062.60

Net Amount:    $390,627.81 - $332,062.6 = $58,565.21

Total Net Impact of PCOs

•                     Total Increases: $136,423.04

•                     Total Credits: ($101,805.84)

•                     Net Change to Contract: +$34,617.20

Expected Impact:

The proposed reconstruction of the park will transform Burnett Bayland Park into a more inviting, functional, and resilient space that encourages community interaction and provides lasting benefits to the surrounding neighborhood within Harris County.  This change order allows for the adjustment and addition of bid items to the contract, ensuring the project is completed in alignment with the original design intent and complies with Precinct requirements.

Alternative Options:

The County may approve or deny the requested funding.  Without approval, the project may not be able to accommodate the necessary adjustments or additions, which could result in incomplete or non-compliant construction, potential delays, and reduced functionality and usability of the park for the community.
