Background and Discussion:

This interlocal agreement was signed on January 8, 2026, with the City of Houston (COH) to grant to the Flood Control District a construction easement over the entirety of the Property and a permanent maintenance easement over the portion of the property on which the Project is located. COH has since transferred the property to the City of Bellaire (Bellaire), so now Bellaire must provide the necessary legal access to the property. The proposed interlocal agreement will provide a construction easement and a permanent maintenance easement to the Flood Control District on the property on which the Project is located. The ILA was approved by the City of Bellaire on August 3, 2026, and executed by the City on August 6, 2026. Due to FEMA grant time sensitivities, the matter of the right-of-entry for construction and maintenance is urgent. The proposed easement has been signed by the City of Bellaire and has been included in this ILA. This project includes construction of an 8.1 acre-ft wet-bottom stormwater detention basin.

 

Expected Impact:

This agreement will contribute to the reduction of risk of street flooding in the Braeswood Boulevard corridor by providing 8.1 acre-ft of stormwater detention.

Alternative Options:

The alternative to approving this item would be not constructing the proposed basin, which would result in not realizing the benefits of the project, and returning unutilized FEMQ funds.
