Background and Discussion:
On October 10, 2023 Commissioners Court approved the execution of an Implementation Service Agreement for HCTRA to deliver a tolling service agreement with Texas Department of Transportation (TxDOT) under which custodial account services would be needed for HCTRA to administer and distribute payments from users of certain tolled projects.
On September 19, 2024 Commissioners Court approved the execution of a Stop Gap Agreement with Zions Bancorporation, N.A. dba Amegy Bank to include a Custodial Account Agreement for implementation of the tolling service agreement with TxDOT. As part of the final negotiations with TxDOT for the tolling service agreement, an amendment to the Custodial Account Agreement is necessary to address administrative requirements from TxDOT toll beneficiaries.
Expected Impact:
Approval of the amended and restated Custodial Account Agreement, as part of the originally approved Stop Gap Agreement, will allow HCTRA to continue to provide reliable back-office system support for tolling services.
Alternative Options:
Should this amended and reinstated Custodial Account Agreement not be approved and executed it places risk on HCTRA being able to provide reliable back-office system support for tolling services to our customers who have placed their trust in HCTRA and Harris County to maintain their tolling accounts accurately and efficiently.
