Background and Discussion:
The above is an eminent domain matter involving the P118-25-00 and Tributaries Conveyance and Detention Improvements - P118-25-00-E001 project located in Precinct 2. The Flood Control District acquired fee simple title to 3,960SF land for purposes of building drainage infrastructure. The acquisitions of the land involved the bifurcation of an existing residence and barn/stable. The County’s retained appraisal expert concluded just compensation totaling $182,450.00. The landowner represented by an attorney were awarded $245,612.00 by the Special Commissioners at a hearing on December 18, 2025. The landowners subsequently filed a timely objection to the award.
The parties engaged in settlement negotiations and reached an agreement on just compensation totaling $295,000.00. This will result in an additional payment of $49,388.00 above the amount previously awarded and deposited into the registry of the Court.
The Engineering Department Real Property Division and Flood Control District participated in the settlement discussions and this settlement is acceptable to them.
An order authorizing the settlement of this lawsuit is attached for use by the Court if it decides it would be in the best interest of the County to settle this claim.
