Background and Discussion:

Harris County desires to construct a detention basin to mitigate the development of Cypress North Houston Road - from Perry Road to Jones Road. The detention basin, along with an interconnection structure (equalizer) will mitigate the roadway development for benefit of Harris County.  Upon construction completion and acceptance, the detention basin and interconnection structure to be owned and operated by Northwest Harris County Municipal Utility District Number 9. The agreement is to compensate Northwest Harris County Municipal Utility District Number 9 for this ongoing maintenance and operation.

The agreement is to also allow Harris County to correct the encroachment of the current Northwest Harris County Municipal Utility District Number 9 detention basin berms (approximately 1,000 feet east of Jones Road on Cypress North Houston Road) during roadway construction.

Harris County agrees to pay a one-time amount to the district for the current and future maintenance costs of the basin and interconnection structure being utilized by Harris County as generally illustrated in the agreement. The District is to provide the invoice to Harris County following their review and approval of the construction award recommendation. Harris County agrees to provide payment within 14 business days of receipt of the invoice.

Expected Impact:

The expected impact of this action will be to more efficiently address the ongoing maintenance and operation of Harris County roadway facilities.

Alternative Options:

An alternative would have Harris County own and maintain the roadway project detention basin facilities which is not desired.
