title

Request for approval of an agreement with the Texas Department of State Health Services to provide Mobile Food Inspection Services, with a contract amount not-to-exceed $536,021.00, effective July 1, 2026 - August 31, 2027.

Background and Discussion:

The Texas Department of State Health Services and Harris County Public Health are parties to an Interlocal Cooperation Contract (Contract No. HHS001719600036) for Mobile Food Inspection Services, with specific work requirements in Attachment A, Statement of Work. State law provides that Chapter 437B preempts a local authority’s power to prohibit or regulate mobile food vendors in a manner that conflicts with that chapter, which may require updates to local requirements and enforcement practices; any resulting county budget impacts are TBD because the attachments do not quantify revenue or cost changes tied to preemption. The contract term runs from July 1, 2026, through August 31, 2027, unless renewed, extended, or terminated under the contract, and the Commissioners Court order authorizes the County Judge to execute the agreement in an amount not to exceed $536,021.00.

Expected Impact:

Court approval will authorize execution of the agreement between Harris County and the Texas Department of State Health Services to provide Mobile Food Inspection Services. Under the Statement of Work, Harris County Public Health will conduct mobile food vendor inspections and complaint investigations as assigned by the Department of State Health Services and submit required inspection reports to the Department of State Health Services within the specified timeframe. Payment is fee-for-service/unit rate, with reimbursements of $250.00 (Type I), $350.00 (Type II), and $400.00 (Type III), including complaint investigations or monitoring/compliance inspections at the same rates, up to the contract maximum.

Alternative Options:

The County could take no action and not execute the agreement, which would mean the agreement would not be authorized by Commissioners Court and the County would not enter into Contract No. HHS001719600036 with the Texas Department of State Health Services. Alternatively, the County could defer approval to a later court date, which would delay execution of the agreement and the contract term stated in the agreement.
