Request by the Harris County Sports & Convention Corporation (HCSCC) for approval of waiver from the requirements of Sections 6.01(i) and 6.10 of the Harris County Sports & Convention Corporation Lease Agreement for NRG Park.

Background and Discussion:
Harris County-HCSCC Lease Section 6.01(i) requires HCSCC to receive Court approval for all specifications for any Capital Repairs and Replacement costing $500,000 or more and construction costing $1,500,000 or more (amounts drafted in 1999), and Section 6.10 requires HCSCC to comply with the County Purchasing Act for any expenditures made with County-provided funds. A waiver of these provisions will allow HCSCC to move forward with projects without subsequent Court approval and to follow HCSCC’s own procurement procedures for upcoming capital maintenance projects in advance of the FIFA World Cup. Without such a waiver, these projects will likely not be completed in time for the matches. Currently planned projects include (1) replacing approximately 423 deteriorated cast iron P-traps throughout NRG Stadium; (2) vertical transportation (escalators and elevators) modernization; (3) various other projects outlined in HCSCC’s Capital Improvement plan that are specifically identified as FIFA-related needs. Each of these efforts is focused on preserving existing facility infrastructure, ensuring operational reliability, and preparing the NRG Park campus for upcoming international events. Granting this waiver is imperative to allow HCSCC to move forward with these projects, maintaining momentum, upholding fiscal responsibility, and meeting critical deadlines.
