Background and Discussion:

The above is an eminent domain matter involving the Clay Road 3-4500 West of Porter Road to West Porter  Road - 181033954828 project, Tract 3, located in Precinct 4. Harris County acquired a fee simple interest of 0.3238 acres (14,105 square feet). The Special Commissioners awarded $67,903.00, and the Defendant/Landowner objected to the award, and the case is currently set for trial. The Landowner demanded $179,386. After a full day of court-ordered mediation, the parties agreed that the just compensation due to the Landowner for the property being acquired is $116,846.00.  The Real Property Division & Precinct Four participated in the settlement negotiations, and this settlement is acceptable to them.  An order authorizing the settlement of this lawsuit is attached for use by the Court if it decides it would be in the County's best interest to settle this claim.
