title

Request for approval of an interlocal agreement with the City of League City, in the amount of $1,250,000, for contribution towards the development of a Section 203 (Water Resources Development Act of 1986, as amended) compliant feasibility study for the Lower Clear Creek and Dickinson Bayou watersheds (Clear Creek Watershed, Bond ID Z-04, Project ID A100-00-00-P009, Agreement No. 2026-02, Precinct 2).

Background and Discussion:

The City and the Flood Control District previously entered into an agreement on October 19, 2019, entitled Agreement No. 2020-64, wherein the Flood Control District contributed $416,000.00 to conduct a local feasibility study that focused on the Clear Creek Watershed, downstream of FM 1959, and Dickinson Bayou watersheds.  The feasibility study investigated whether a tunnel or other flood risk management tools are feasible.  The next step recommendation of that study was to prepare a feasibility study that recommends a flood risk management plan that is eligible for federal cost share.

This project is that next step, and was authorized under the Water Resources Development Act of 2022; however, no Congressional appropriation has been provided.  To accelerate the preparation of federally compliant feasibility study, the City is utilizing the authority provided under Section 203 of the Water Resources Development Act of 1986, as amended by Section 1014(a) of the Water Resources Reform and Development Act (WRRDA) of 2014.  Under Section 203 authority, feasibility studies prepared by a non-Federal sponsor must comply with all requirements that would apply to a feasibility study undertaken by the USACE, including full compliance with the NEPA.  As the non-Federal sponsors, League City is able to undertake a feasibility study of Project for submission to the Secretary of the Army.

This project includes the Clear Creek channel downstream of FM 1959, which is downstream of the current limits of the Clear Creek Federal Flood Risk Management Project (HCFCD Project ID A100-00-00-G002), which is currently in the Design and Construction phase.  It also includes the Dickinson Bayou watershed.  The study will exclude the area associated with the Harris County Section 203, which is also investigating an array of alternatives including tunnels.

Expected Impact:

This agreement will investigate an array of flood risk management tools (e.g., no action, structural, structural, etc.) that can potentially reduce the flood risk along the lower Clear Creek and Dickinson Bayou watersheds.

Alternative Options:

The alternative to approving this item would be providing no contribution which would result in delay or cancellation of the Section 203 Feasibility Study.
