Background and Discussion:
The Peden Building project was substantially completed November 7th, 2023, and DivisionOne Construction LLC, has completed closeouts for the originally contracted work. The only work remaining is the negotiation of outstanding change orders.
Expected Impact:
This court action would allow the Contractor to bill for a partial amount of the due retainage compensation for work performed and completed.
Alternative Options:
Should we not move forward with this action, Retainage will continue to be withheld on contractors for work completed after contractual Substantial Completion has been declared.
