Background and Discussion:

On October 11, 2006, the Harris County Commissioners Court approved the Harris County Housing and Community Development Department (formerly CEDD) to become a Direct Recipient of the Federal Transit Administration funds under the Urbanized Funding Formula.

The Federal Transit Administration requires that each recipient of transportation funds must attest to and comply with the Certifications and Assurances annually as a condition to apply for new funds or draw down existing funds. The Harris County Housing and Community Development Department Transit Services Director and a Harris County Attorney’s Office designee were assigned by the Federal Transit Administration in 2006 to execute annual Certifications and Assurances.

Expected Impact:

No fiscal impact with this request. This permission to execute the Federal Transit Administration 2026 Certifications and Assurances is not a request for additional funding but to comply with federal regulations. Failure to attest to and execute the Certifications and Assurances within 90 days from federal publishing will result in freezing of current funding for reimbursement and the inability to apply for more Federal Transit Administration funding.

Alternative Options:

Failure to comply with acceptance and execution of the Certifications and Assurances would result in the County and/or participating cities having to use General Funds for all the current transit projects. The other alternative would be to reduce or close the projects which would disenfranchise thousands of transit dependent residents that use public transportation.
