Background and Discussion:

The existing restroom building at Mercer Botanic Gardens is a wood-framed building constructed in or around 1977, with an addition added to the building sometime later. The blue building is in the 100-year floodplain and in poor condition. This change in contract includes adding a handrail system to meet requirements of the Americans with Disabilities Act of 1990 and Texas Department of Licensing and Regulations.

Expected Impact:

This court action would account for necessary changes to the project schedule and meet requirements of the Americans with Disabilities Act of 1990 and Texas Department of Licensing and Regulations.

Alternative Options:

Should we not move forward with this change in order we would revise the design layout, remove existing concrete, and install new concrete that meets federal and state disability standards which would have a significant cost and schedule impact to this project.

Alignment with Goal(s):

_ Justice and Safety

_ Economic Opportunity

_ Housing

_ Public Health

_ Transportation

_ Flooding

_ Environment

X Governance and Customer Service
