Background and Discussion:

On September 21, 2024, the load of a truck driven by Curtis Craft and owned by O & B Enterprises LLC became wedged under the AstroWorld pedestrian footbridge that spans over Interstate 610 South between Kirby Drive and Fannin Street causing severe damage. The truck was carrying a large cylindrical chemical load vessel, owned by John Doe, and marked “OVERSIZE LOAD”. The Houston Police Department reported that the cause of the accident was insufficient clearance.  Repairs for the damage to the footbridge total $1,133,237.32, for which O & B Enterprises LLC, Curtis Craft, and John Doe are jointly and severally liable under Texas Transportation Code § 251.160. According to the US DOT SAFER website, an insurance policy issued to O & B Enterprises LLC has coverage of $750,000, although this insurance policy could be partially or fully depleted by any claims from John Doe for damage to its load. Harris County seeks to recover payment of all damages it sustained as a result of this incident.
