Background and Discussion:

The Harris County Housing and Community Development Department (HCHCD) requests approval of a Resolution of Support for the Hartwood at Barker Cypress 9% Multi-Family Housing Tax Credit affordable housing development. The project has been reviewed by HCHCD staff and meets all applicable guidelines and criteria established in the County’s Housing Tax Credit Resolution Request Policy.

The proposed development is located within the City of Houston’s Extra-Territorial Jurisdiction (ETJ). As part of the Texas Department of Housing and Community Affairs (TDHCA) application requirements, the developer will also request a Resolution of Support from the City of Houston.

On June 25, 2019, the Harris County Commissioners Court approved the Multi-Family Rental Housing and Housing Tax Credit Application Review and Resolution Request Policy and Criteria. These guidelines align with the goals of the Harris County Consolidated Plan and Fair Housing Assessment and are intended to promote and preserve quality affordable housing throughout Harris County.

Under TDHCA’s Qualified Allocation Plan (QAP), developers seeking Housing Tax Credits must request a resolution from the applicable local government expressing either support or no objection to the proposed development. TDHCA awards points for these resolutions as part of the competitive tax credit application process. Pursuant to QAP requirements, 9% Housing Tax Credit applications may request either a Resolution of Support or a Resolution of No Objection, while 4% Housing Tax Credit applications may only request a Resolution of No Objection.

HCHCD staff evaluates each application for consistency with the adopted policy and criteria and makes a recommendation to the Harris County Commissioners Court when all requirements are met. A resolution from the local government does not guarantee funding from Harris County or the award of tax credits by TDHCA; rather, it indicates support or no objection to the proposed development within the County’s jurisdiction.

Based on staff review and analysis, HCHCD recommends that the Harris County Commissioners Court approve the Resolution of Support for Hartwood at Barker Cypress.

Expected Impact:

Approving the resolution of support for this project will satisfy the TDHCA QAP tax credit application requirement for the developer to seek local government support for the project and increase the likelihood that this project will receive appropriate financing to provide additional opportunities for quality and affordable housing in Harris County. No fiscal impact to the County is anticipated.

Alternative Options:

If the Resolution of Support is not approved, it will deny the proposed development the necessary support and reduce the chance of the 9% HTC application to TDHCA receiving a tax credit, ultimately reducing the likelihood of the proposed affordable housing units being constructed.
