Background and Discussion:
Texas Senate Bill 9 (SB 9) restructures the state's bail system by shifting bail-setting authority for certain violent offense cases from magistrates to elected judges. This change places additional pressure on the County's already high-volume felony docket. To prepare for these increased demands, Commissioners Court approved a $1M appropriation in the FY26 budget. At that time, the Commissioners Court requested that OCA Justice Innovation monitor process changes and report to the Court ongoing needs related to the implementation of SB9 across the impacted departments.
Expected Impact:
Since implementation, SB 9 has created sustained operational strain across key justice-system departments. The County's compliance model-requiring expanded weekday, weekend, and holiday processes-has maintained continuity but relies heavily on overtime, compensatory time, staff reassignments, and emergency support. The District Courts, District Clerk's Office, Public Defender's Office, and Pretrial Services will incur ongoing resource needs to continue meeting SB 9 requirements without disruption.
