Background and Discussion:
The proposed adjustments will replace / relocate existing PS LIGHTWAVE facilities that conflict with the proposed State Highway 225 / Sam Houston Tollway East Interchange construction project. The adjustment includes underground telecommunication facilities.
After completion of the construction services, if the estimated cost is less than the estimated amount, PS LIGHTWAVE will refund or credit the difference. If actual cost of the construction services is more than the estimated cost, PS LIGHTWAVE will invoice the difference which would require a future Court action.
Expected Impact:
The Agreement allows PS LIGHTWAVE to expedite the telecommunication underground line adjustments, minimizing the risk of construction delays for the Project.
