Request for approval of the development (including applicable tax exemptions) of a new multi-family housing facility at 9310 North Sam Houston Parkway East in Humble, TX, Precinct 1 pursuant to the Texas Local Government Code ?303.042 and ?303.0421 with such approval subject to the execution of an agreement between Harris County and Lakeside Place PFC.

Background and Discussion:
Such agreement will require that Lakeside Place PFC agree to the following: (i) to comply with all State and local laws and regulations relating to public facility corporations, (ii) to include, for each rent and income restricted unit, the Tenant Protections in each lease, in substantially similar form to the attached standard Tenant Protections for Harris County, (iii) the mutual execution and recordation of a Regulatory Agreement restricting the use of the property for affordable housing for a period of ten (10) years.
Pursuant to Chapter 303 Local Government Code (303.042c), and 303.0421(b)(3), the Lakeside Place PFC is required to provide written notice to the Presiding Officer of the Governing Body informing the jurisdictions of a planned development of The Oaks at Fall Creek Apartments. The County Attorney's Office has reviewed the request. The new workforce housing development will receive an exemption from HCAD for the PFC with a land use regulatory agreement providing for the income targeting described below.
