Background and Discussion:
The County Attorney requests approval to join an amicus brief filed by the City of Santa Clara in support of the federal government in United States v. Idaho, now pending before the U.S. Supreme Court. In this appeal, the State of Idaho seeks to overturn a preliminary injunction that bars the enforcement of Idaho's abortion ban to the extent the ban purports to prohibit the provision of abortion in emergency circumstances where such care is required under the Emergency Medical Treatment & Labor Act (EMTALA). Harris County joined an earlier iteration of this litigation in Texas v. Becerra.

The amicus brief in support of the federal government will highlight how delaying or denying access to abortion care in situations where a person is experiencing a serious threat to their health as a result of pregnancy-or where a threat to their health is compounded by pregnancy-can have grave short- and long-term health impacts and can undermine public health.
